TERMS & CONDITIONS

1. PROMOTION PERIOD
Promotion will span from April 20th, 2009 until April 30th, 2009.

2. HOW TO ENTER:
Enter your e-mail address in the correct box and approve terms & conditions. Product choice will be made by the winners after the end of the promotion.

3. PRIZE
A free Lemur or Dexter. One per winner. JazzMutant will giveaway a total of 5 Lemurs or Dexters combined during this promotion. Winners will be contacted after June 1st, 2009.

No alternative prize, cash equivalent, or other substitution in the event of prize unavailability. Prizes are non transferable. All federal, state and/or local taxes are the sole responsibility of the customers.

4. GENERAL RULES:
By accepting a prize, customers release and hold harmless JazzMutant and any of its affiliates and promotion agencies and all of their respective persons and agents from all liability or claims whatsoever for injuries or losses to persons, including the beneficiary, and property, which may be sustained, directly or indirectly, in connection with this promotion or by reason of the receipt, acceptance, possession or misuse of the prizes. By entering this Promotion, entrants accept and agree to be bound by these official rules.

JazzMutant is not responsible for and shall not be liable for: (I) lost, late, delayed, damaged, incomplete, illegible, unintelligible, or misdirected orders; (II) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (III) failed, incomplete, partial, garbled, or delayed computer transmissions; (IV) any condition caused by events beyond the control of JazzMutant that may cause the Promotion to be disrupted or corrupted; (V) any injuries, losses, or damages of any kind arising in connection with or as a result of a prize, or acceptance, possession, or use of a prize, or from participation in the Promotion; or (VI) any printing or typographical errors in any materials associated with the Promotion. JazzMutant reserves the rights to suspend, cancel, or modify the Promotion if fraud or technical failure corrupts the administration, security, or proper conduct of the Promotion, as determined by JazzMutant in its sole discretion. Each participant agrees to release and hold JazzMutant harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Promotion or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, property damage, and claims based upon publicity rights, defamation, or invasion of privacy. Participant agrees that JazzMutant's obligation is fair and adequate consideration for the free product giveaway submitted, and that participant is not entitled to and shall not seek any further compensation. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participant and JazzMutant in connection with the Promotion, shall be governed by, and construed in accordance with the laws of France, without giving effect to any choice of law or conflict of law rules or provisions (whether of France or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than of France.
